Notice of the People’s Government of Liaoning Province on Cancelling and Stopping the Collection of 220 Administrative Fees
Municipal People’s governments, provincial government departments and commissions, and directly affiliated institutions:
In order to further implement the Opinions of Liaoning Provincial People’s Government of Liaoning Provincial Committee of the Communist Party of China on Implementing the Policy of Expanding Domestic Demand to Promote the Sustained and Rapid Development of the Province’s Economy (Liao Wei Fa [2008] No.18) and the Opinions of Liaoning Provincial People’s Government of Liaoning Provincial Committee of the Communist Party of China on Further Strengthening the Operation of the Province’s Industrial Economy (Liao Wei Fa [2008] No.20), we will further promote administration according to law and effectively reduce the burden on enterprises and the masses in accordance with the requirements of the state. We hereby notify you as follows:
First, since January 1, 2009, 220 administrative fees have been cancelled and stopped in the whole province.
Two, the above administrative fees and charges to cancel and stop the collection, the relevant departments and units to perform administrative functions in accordance with the law, the funds needed by the budget at the same level to be arranged.
1 for administrative organs, administrative organs entrusted to perform administrative functions in accordance with the full subsidy and differential subsidy institutions, the required work funds shall be approved by the financial department at the same level according to the needs of the work through the departmental budget; Certificates such as forms, certificates, bills, books, etc., which belong to the performance of government functions, are distributed by administrative organs in accordance with laws and regulations, and the printing costs required are all included in the budget of the financial department at the same level for forms, certificates, bills, books, etc., and are uniformly printed by the financial department to the public.
2. For self-supporting institutions that are entrusted by administrative organs to exercise administrative functions according to law, the required funds shall be allocated by the financial department at the same level through arranging the project expenditure budget of the administrative department; Those who have not been entrusted by administrative organs to exercise administrative functions shall be dealt with by personnel and organization departments at all levels in combination with institutional reform of public institutions, and the financial department may temporarily give appropriate financial subsidies during the disposal period.
3. The institutions affiliated to the transportation department involved in the national levy of fuel consumption tax and the cancellation of road maintenance fees should be implemented in accordance with the relevant provisions of the central fuel tax reform plan.
Third, in the future, where relevant enterprises or self-supporting institutions fail to perform government functions, fees will be charged according to market rules, and they will no longer be included in the scope of government administrative fees management, and relevant government departments will no longer implement project approval.
Four, strengthen the management of examination and approval of administrative fees. In the future, any newly established administrative fees and charges (except those explicitly stipulated by laws and regulations) shall be audited by the provincial finance and price departments, and shall be submitted to the provincial government for examination and approval after passing the demonstration meeting and hearing.
Five, after the cancellation and stop the collection of administrative fees, the relevant collecting departments and units should go through the cancellation procedures of the License for Charging and the Certificate of Entrustment for Non-tax Revenue Collection in accordance with the provisions of the finance department and the price department, and go through the cancellation procedures of the bills at the finance department that originally issued the financial bills. Before January 1, 2009, the balance of relevant fees should be turned over to the state treasury or financial special account in strict accordance with the original channels stipulated by the financial department.
Six, governments at all levels and their relevant departments should strictly implement the provisions of this notice, and shall not delay or refuse to implement it for any reason. Financial departments and price departments at all levels should strengthen supervision and inspection of the implementation of this notice, and departments and units that fail to cancel and stop collecting administrative fees according to regulations should be punished according to regulations, and the administrative responsibilities of relevant responsible personnel should be investigated.
Seven, the municipal government and its financial department, the competent price department to comprehensively clean up the local administrative fees, the illegal and unreasonable fees should be immediately announced to cancel or stop the collection, and reported to the Provincial Department of Finance, the Provincial Price Bureau for the record.
